Â§ 40-1509, Burns 1952 Repl.; which alleged, in substance, that on November 26, 1957, he was employed by defendant appellee, Concrete Ready-Mix Company, in unloading cement from a Monon Railroad freight car. While engaged in this in task, appellant alleges he received injuries by reason of an accident arising out of and in the course of his employment.
